Y., Fanny Jane Case, born April 2, 1820, died Middlebury, Ind., Aug. 20, 1848, daughter of Joshua and

    Betsey (Vail) Case; married 3d, Matilda Ann Gardner, born Fall River, Mass., Dec. 6, 1809, died Nov. 4, 1876, daughter of Peleg Gardner. He was a prosperous farmer and a valued citizen, and with his family always aided in up-building the communities in which he lived. He resided in Vernon, N. J., until he was married, then in New York until 1837, when he went to Middlebury, Ind., where he lived until Dec., 1865, when he moved to Portland, Mich.

    I, 88th Ind. Infantry. Later he was in command of the
    company. He was in the Army of the Cumberland,
    taking part in the battles of Perrysville and Stone River,
    and was taken prisoner at the Battle of Chickamauga,
    Sept. 20, 1863. He was sent to Libby prison at Richmond,
    then to Macon, Ga., later to Charleston, S. C.
    The hardships of the rebel prisons broke him down and
    he died in Charleston, S. C. He gave promise of becoming
    a man of rare merit.

    I'm interested in finding out about any descendants of Joshua Case(1780-1853) and Betsey Vail(1783-1850 d/o Alsop) who moved to Elkhart County around 1836 from Ontario County, NY. Heirs mentioned in Joshua's probate records are:

    Emma Case(deceased) married to Samuel H Weyburn
    (their son Oscar named as heir)
    Elvira Case married to John Wesley Benham
    (they had Charles, George, Jonathon & Henrietta)
    Lewis Ferdinand Case, Sr. married to Mahitable T Benham
    (they had Joel??, Benjamin, Esther, Mary, Lewis & Julia)
    John C Case married to Mary Copeland
    (they had Elizabeth and Eugene)
    Benjamin V Case married to Abigail Whitney Amsden
    (they had Isaac and Edna)
    Isaac Case married to Z Cordelia E Woodworth (Weyburn)
    (they had Elwyn, Annette & Frances)
    Fanny (Frances) Jane Case(deceased) married to Thomas DeKay Kimball
    (their son Francis named as heir)
    Joshua Case(apparently single in 1853)
    May A Case(apparently single in 1853)

    Also Joshua and Betsey had a daughter Betsey who died unmarried in NY in 1836. They may also have had a son named Joel who was not mentioned in the probate.

    It is possible that Joshua had a brother named Isaac Case married to Maria Benham (Amsden) who may be the father of a few of these children. This Isaac and Maria are buried in Middlebury with along with Benjamin, Abigail, Lewis, Mahitable, Joshua and Betsey Case.

    I have a fair amount of info on the descendants of Benjamin and his son Isaac. I would appreciate any info in the others.

    Joshua came from Orange Co, NY. Joshua was one of the first settlers of Hopewell(Gorham), Ontario County, NY. He purchased land in Elkhart Co, Indiana in 1836. In his probate records in Elkhart Co, Indiana, he names Benjamin Case as his Administrator as well as one of many heirs. The Ketcham family history by Electa Ketcham Penney lists Joshua as a son of John Case and Elizabeth Ketcham. The Ketcham book does not list Emma, William or Betsey as children of Joshua. I include them because they were heirs. I have been unable to get a copy of the will, but have listed children based on who was given money from the estate. Betsey's maiden name "Vail" is supported by the Kimball family history which includes Fanny Jane Case Kimball. See "History of the Kimball Family, Vol. 2", by Leonard Allison Morrison, Damrell & Upham, Boston, 1897.

    Joshua's brother Isaac, also died in Middlebury, and I am uncertain if any children belong to Isaac. I was unable to get a copy of Isaac's probate record, which also listed Benjamin Case as executor. Isaac was married to Benjamin V Case's mother in law, and this may be a reason he was his executor, especially if Isaac had no children.

    According to Ella Morgan Case, Joshua was distantly related to Leonard Case, Jr. b.7/29/1786, who founded the Case Western Reserve school in Cleveland, OH, the son of Leonard Case, Sr. and M Elizabeth Gaylord of Cleveland. Leonard Case believed his Case ancestors were of Dutch descent, however I have not found proof that the Long Island Case's were Dutch. Leonard descended from Theopolis Case, Jr. His ancestors apparently came from England in the 1600's.

    My Elizabeth(Betsey) died 4/2/1850 and is buried in Forest Grove Cem, Middlebury, Elkhart, IN with husband Joshua Case(1780-1853). In the Benham Cemetery in Hopewell, Ontario, NY there is a grave for Betsey Case d/o J & B Case as well a grave for Alsop Case s/o James & Mehitable Case. I know for certain that my Cases did live in Hopewell, and Joshua Case is documented as one of their earliest settlers, but I am not certain that my Betsey is Elizabeth Vail d/o Alsop. It does seem a very strange coincidence that one of the Cases in Hopewell had a child named Alsop though. What do you think? Is this just wishful thinking? Like you, I find Joshua Case to be a dead end. We'll have to keep in touch since I'm sure if I find out more it will either apply to you or me, but not both. I have written to the Ontario County Historical Library for assistnce but it has been almost 3 months, and they assure me that it takes a long time. Have you found out any more about where Joshua came from? I looked at the website for Sullivan County, NY and Wayne Co, PA, but found nothing on Joshua. There were other Cases and Vails though. I think there must have been many different Case families in New York at that time. Some from Long Island, others from VT, Connecticutt, and Rhode Island.

    Alsop Vail, (1761-1840), was a private in the Ulster New York militia under Col. James McClaghrey. He was born and died in Orange county, N. Y.

    The biggest bargain was the pair of Ammi Phillips life-size portraits of Alsop Vail ("Aged 65 Years") and Frances Vail ("Aged 69 Years"), dated 1826 and signed on the front "A. Phillips Pincit." They are among 19 other signed and dated portraits by this prolific artist, but only one other pair of Phillips portraits is signed and dated on the front as these were. Estimated conservatively to bring $30,000 to $50,000, they sold to a New York doctor for $27,600. Apparently, he was bidding against the reserve.

    As they came on the block, another doctor was overheard telling his wife he thought the pair would go for $75,000. When bidding died at $24,000, he asked her, "Should I bid?" Turning around to see who was bidding, he shook his head and said, "I can't do it; we are on the same staff at the hospital." Reportedly, the pictures had been offered for $100,000 in the late 1980's. Rumor has it Davidson paid $70,000 for them.

    They are fine paintings, and several collectors said after the sale they would have bid on them if they thought they could have bought them so reasonably. The excuse for the trade's passing them by was that portraits of elderly sitters are not easy to sell.

    Benjamin Vail (1740-79) commanded a company in Colonel Hawthorne's Orange County, NY regiment, at Minisink, on the Delaware. He was killed in battle.

    Benjamin Vail (1740-79) was a captain in Colonel Hathorn's regiment of militia and was killed at the battle of Minisink. He was born in Orange County, N. Y.
