- John, served heir to John his father 5 August 1718 in Brigton, Ingliston and Scrogerfield.
Charles, 6th earl of Kinghorn, succeeded his brother 1715. The earl came to Forfar, on Thursday, May 9, to attend the funeral of a young lady, and after dinner went to a tavern with James Carnegie of Finhaven, John Lyon of Brigton, and others. Lord Strathmore and Finhaven, then paying a visit to lady Aucterhouse, Fiuhaven's sister, Brigton followed them, and behaved rndely to the lady and her brother. Lord Strathmore thereupon left the house, and came into the street, it being then letween eight and nine o'clock in the evening. Finhaven and Brigton following, some words passed betwixt them, when Brigton pushed Finhaven into a kennel, two feet deep, from which a servant of lord Strathmore's assisted him to get out. Finhaven immediately drew his sword, and pursued Brigton, with a staggering pace. Brigton run towards lord Strathmore, whose back was to him, and endeavoured to draw his lordship's sword. Finhaven comint: up, made a pass at Brigton; but lord Strati-more turning hastily about, and pushing off Brigton, threw himself m the way of Finhaven's sword, which run through his body, and his lordship died, in consequence cf that wound, on Saturday, May 11, 1728. Finhaven was brought to his trial, for the murder of his lordship, before the Court of Justiciary, at Edinburgh, Aug. 2, 1728, and was acquitted through the superior ahility and firmness of his counsel, Robert Dundas, of Arniston, who told the jury that they were jndges of the law as well as of fact; thereby establishing that important ant constitutional point.
