Burke's 1847. The third son (of John Rutherfurd of that Ilk) THOMAS RUTHERFCRD of that ilk succeeded his father and brother Andrew, who d without lawful issue in 1718. He also acquired the lands of Bonjedward and Mounthooly together with the lands of Hunthill and Serais burgh from Robert Lord Rutherfurd who likewise assigned to Thomas with the estate the title of Lord Rutherfurd in like manner as it bad been aligned to his brothers and to him by the Earl of Teviot by virtue of the patent which was the only right they had But T horn as esteeming a Scots peerage rather a loss than an advantage contented himself with assigning it in like manner to his son and successor who likewise declined claiming it. It was however assumed by Captain John Rutherfurd collateral heir male descended from Richard Rutherfurd of Littlehaugh and since by others. He m Susanna dau and heiress of Riddell of Minto of the ancient family of Riddell of that ilk by Catherine Nisbet sister to Sir John Nisbet of Dirleton Lord advocate and senator of the College of Justice and had one son and flve daus
